1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you ("Client", "User", or "you") and Free Business Sites ("Company", "we", "us", or "our") concerning your access to and use of our website, custom web development services, hosting, CRM automations, and AI tools. By applying for a website build or using our services, you agree to be bound by these Terms.
2. Free Website Design & $0 Upfront Offer
We provide custom website layout design, copywriting setup, and mobile optimization at zero upfront design fee ($0 setup charge). In consideration for this service:
- You agree to subscribe to one of our monthly hosting, CRM, and maintenance tiers ($99/m or $199/m) upon launch approval.
- If you decide not to launch the website or cancel before going live, you owe zero design fees, but the created design mockup remains the sole intellectual property of Free Business Sites.
- Once active, you own all text, logos, media, and customer content uploaded to your website.
3. Subscription Tiers & Billing
Services are billed on a recurring monthly basis ($99/month or $199/month, or agreed custom Enterprise pricing).
- No Lock-In Contracts: You may cancel your monthly maintenance plan at any time with 7 days written notice prior to your next billing cycle.
- Unlimited Edits: Active subscribers receive unlimited content updates, text revisions, image swaps, and form field adjustments.
- Hosting & Domain: Managed hosting, SSL encryption, and server uptime are maintained continuously as long as your subscription remains active.
4. SMS & Automated Communications Compliance
Our platform includes automated SMS form notifications, speed-to-lead text back features, and Google Review AI requests. By activating these features:
- You represent and warrant that you have obtained proper consent from your customers to contact them via SMS or email in accordance with TCPA, CTIA, and local privacy laws.
- You agree not to use our messaging system to send unsolicited bulk spam, deceptive offers, or prohibited content.
5. Limitation of Liability
In no event will Free Business Sites or its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the website, hosting downtime, or automated communications.
6. Changes to Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. We will alert you about any changes by updating the "Last Updated" date of these Terms.
